Vulcan and Town of Sahuarita sign agreement as of 5-06-2023.  Our CCS work is complete. 

     VULCAN MATERIALS TYPE 3 CONDITIONAL USE PERMIT*

Overview: A request for a Type 3 Conditional Use Permit for a Hot Mix Asphalt Plant at 18701 S. Old Nogales Highway,  (Case No. SA6-23-00001)

Status: The Town Council has approved, and Vulcan has signed, an agreement that vests existing property rights for the property but WITHOUT the right to apply for an asphalt plant. Per the agreement, Vulcan plans to withdraw the Type 3 CUP application. The agreement will be recorded with Pima County on May 28 once the required 30-day waiting period has expired.

Vulcan Proposed Development Agreement  as of 04-24-2024 

Vulcan and the Town Council have negotiated a development agreement. View it HERE attached to the Agenda document. 

The agreement was approved at the April 24, 2024 Special Town Council Meeting. The next steps are for the Town of Sahuarita to sign the agreement and then Vulcan will countersign.  Once fully executed Vulcan will withdraw the Asphalt Plant CUP application. 

Vulcan and any future owners of the property are limited from placing an asphalt plant on the property in perpetuity.  Vulcan is allowed to continue the rock and gravel business and can apply in the future by submitting a CUP application to the town to build a cement plant on this site.

Reviews and Approval Status on Asphalt Plant CUP 

Working groups and citizens reviewed the updated Vulcan Response to CUP and provided additional documents addressing concerns with the Town Staff and offering to meet with them to discuss.

The Town Staff will process the revised permit application and deliver a full report to their commission. The report will be released 10-days prior to the first public hearing that is yet to be scheduled.  Link to Town Council Public Hearing Information  Link to CUP Approval Process: HERE.

Town Status from their website: Under review. Vulcan provided an air modeling study to better assess the potential impacts of the proposed hot mix asphalt plant. The study was submitted in early January. To allow adequate time for the Town's third-party consultant to review this important study, public hearing dates are now being targeted for May or later. Continued Monitoring and Tracking

We are tracking the progress of the Town Staff, their continued interactions with the permit applicant, Vulcan Materials. You can read the Town Staff’s updates on their website. (Click ‘Other’ to see the Vulcan project).

We continue to track concerned citizens submitting conditions for the permit and other suggestions to a fair resolution to properly locate the asphalt plant. This includes enhancing relationships with UPRR, government agencies, equipment vendors and other sources.  

We will maintain a communications channel with Vulcan representatives in order to maximize our abilities to affect a good outcome.

CCS will submit white papers/CUP condition recommendations to the Town Staff. Over 20 residents are completing their work in the areas of environment & health, transportation (highway and rail), general plan non-conformance, public awareness, CUP requirements, property values and water usage. Conditions submitted to-date can be reviewed here.


The Town of Sahuarita received the second submittal on June 16th.

The Union Pacific Railroad is working with Vulcan on a revised agreement and also performed an engineering study. We are tracking their progress and working with the town to propose more stringent requirements.
